The latest developments include a significant ruling by a magistrate judge, who found that prosecutors mishandled attorney-client communications between Comey and his former lawyer, Daniel Richman, a Columbia Law School professor. As of now, the magistrate judge has not moved to dismiss the case, but French cautioned that Halligan’s procedural blunders could have fatal consequences for the prosecution. “We do not yet know if Halligan’s procedural irregularities will be fatal to the case, but if I’d committed that level of malpractice, it would have been instantly fatal to my continued employment,” he concluded.
