Judge Questions DOJ Readiness in Letitia James Arraignment
UPDATE: Tensions escalated in a Norfolk, Virginia courtroom on October 6, 2023, as U.S. District Judge Jamar Walker challenged the DOJ’s preparedness in the federal case against New York Attorney General Letitia James. During the arraignment, Assistant U.S. Attorney Roger Keller Jr. admitted the prosecution is still sifting through evidence, stating, “I am going through the discovery right now.”
The admission raised eyebrows as James pleaded not guilty to the charges, leaving the courtroom on edge about the government’s readiness. Judge Walker pressed for clarity, remarking, “Normally, prosecutors fully investigate a case before pursuing an indictment.” Keller’s request for an extension until mid-November to finalize evidentiary disclosures was swiftly denied. “Waiting nearly a month after an indictment is not consistent with how we operate here,” Walker emphasized, highlighting the urgency of the situation.
Keller proposed a two-week trial with an estimated eight to ten witnesses, but James’ defense lawyer, Abbe Lowell, expressed skepticism, stating he’d “be shocked” if the prosecution could produce even that many witnesses. When asked about the pretrial services report, Keller hesitated, leading the judge to question, “Do you need a moment?” This moment underscored the apparent lack of preparation from the prosecution’s team.
The hearing lasted less than an hour, indicating a rushed and disorganized approach as the government continues to build its case against James. Observers noted that this situation bears similarities to the prosecution of former FBI Director James Comey, where the government also admitted to struggling with evidence collection.
Following the arraignment, Letitia James addressed a supportive crowd, condemning the justice system as a “tool of revenge.” Her strong statements reflect the emotional weight of the proceedings, underscoring the high stakes involved.
As this case develops, all eyes will be on the DOJ’s next moves and how they plan to solidify their arguments in the coming weeks. The implications of this trial are significant, not only for James but for the broader political landscape as well. Stay tuned for further updates as this urgent legal drama unfolds.
