New York Lawmakers Face Urgent Debate on Raise the Age Law
UPDATE: New York lawmakers are gearing up for a crucial debate on the controversial Raise the Age law, which prevents youth offenders aged 16 and 17 from being tried as adults. With the new legislative session approaching, this urgent discussion comes as New York City’s mayor-elect, Zohran Mamdani, supports changes pushed by his newly appointed NYPD Commissioner, Jessica Tisch.
Tisch, who has labeled the existing policy as having created a “consequence-free environment” for young offenders, highlighted alarming statistics at a recent event: the number of shooting victims among children is up 83%, while youth offenders involved in shootings has surged almost 100% since the law was enacted in 2017. “The data is telling us a very clear, stark story,” she stated, emphasizing the need for adjustments based on the realities facing communities today.
Key figures, including Bronx District Attorney Darcel Clark and Brooklyn District Attorney Eric Gonzalez, have discussed the law’s future at the SOMOS conference in Puerto Rico. While Clark has supported amendments since 2021, Gonzalez’s office has refrained from commenting on the ongoing discussions.
Amid these developments, Assemblywoman Latrice Walker, a staunch defender of the Raise the Age initiative, expressed concern over potential changes, asserting that judges should retain the discretion to determine case outcomes. She stated, “There are opportunities for both sides to be heard,” warning against legislation that might undermine judicial authority.
As the debate heats up, Governor Kathy Hochul has yet to take a definitive stance on the proposed reforms. Her office reiterated her commitment to reviewing all laws as she prepares for the upcoming legislative session. Hochul’s mixed record on criminal justice reform, combined with the pressure from Tisch and various district attorneys, raises questions about the future of the Raise the Age law.
The District Attorneys Association of the State of New York is advocating for legislative changes, citing the need for transparency in family court cases, which are typically sealed from law enforcement and prosecutors. President Mary Pat Donnelly emphasized, “We need the ability to know what’s going on in family courts so we can make informed decisions about whether cases should go to adult court.”
Discussions among state lawmakers are intensifying, with members of the Black, Puerto Rican, Hispanic, and Legislative Caucus pushing for a funding mechanism that prioritizes youth services over legislative changes. Caucus Chair Michaelle Solages stated, “Attempts to change the law through the budget or through prosecutors who have not fully implemented Raise the Age are irresponsible.”
As negotiations continue, the urgency for a resolution grows. The outcome of these discussions will have significant implications for the justice system and the treatment of young offenders in New York. Observers are closely watching how the dynamics will shift as the new legislative session approaches in January, with the potential for Governor Hochul to align with either the reform advocates or the defenders of the current law.
